1. Acceptance of Terms

These Terms of Service ("Terms") govern your use of the Fliqer mobile application ("App") developed by Egor Sazanov ("we," "us," or "our"). By accessing or using the App, you agree to these Terms and our Privacy Policy.

2. Description of Service

Fliqer is a professional iOS application that allows users to:

• Browse videos from their photo library
• Extract individual frames from videos with high precision
• Save extracted frames in multiple formats (JPG, PNG, HEIC)
• Manage frame extraction credits and subscriptions
• Navigate through video collections efficiently

3. Eligibility

You must be at least 13 years old to use Fliqer. By using the App, you represent that you meet this age requirement and have the legal capacity to enter into these Terms.

4. License and Restrictions

4.1 License Grant

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

• Download and install the App on your iOS devices
• Use the App for personal, non-commercial purposes

4.2 Restrictions

You agree NOT to:

• Reverse engineer, decompile, or disassemble the App
• Modify, adapt, or create derivative works of the App
• Remove or alter any copyright, trademark, or proprietary notices
• Use the App for illegal or unauthorized purposes
• Circumvent any technical limitations or security measures
• Resell, rent, lease, or sublicense the App
• Use automated systems to extract frames in bulk
• Abuse the credits system or attempt to manipulate balances

5. Credits System and Subscriptions

5.1 Frame Extraction Credits

Fliqer uses a credits-based system where each extracted frame consumes one credit. Credits are managed as follows:

5.2 Add-on Credits

You can purchase additional credits as add-ons:

Add-on credits do not expire and remain available until used.

5.3 Credits Priority

Credits are consumed in the following order:

1. Monthly subscription credits (reset monthly)
2. Add-on credits (persistent)

5.4 Subscription Terms

• Auto-Renewal: Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period.
• Billing: You will be charged through your Apple ID account.
• Cancellation: Manage subscriptions in App Store settings.
• No Refunds: We do not provide refunds for unused credits or partial subscription periods, except as required by law.

6. Purchases and Payments

6.1 Payment Processing

All purchases are processed through Apple's App Store. By making a purchase, you agree to Apple's terms and conditions.

6.2 Pricing

Prices are subject to change without notice. Price changes will not affect existing subscriptions until renewal.

6.3 Taxes

You are responsible for any applicable taxes in your jurisdiction.

6.4 Free Trial

If a free trial is offered, it will be clearly disclosed before purchase. You must cancel before the trial ends to avoid charges.

7. User Content and Responsibilities

7.1 Your Content

You retain all rights to your videos and extracted frames. We do not claim ownership of your content.

7.2 Content Restrictions

You agree not to use Fliqer to process content that:

• Violates laws or regulations
• Infringes on intellectual property rights of others
• Contains explicit, obscene, or harmful material involving minors
• Promotes violence, hatred, or discrimination
• Violates privacy rights of others

7.3 Responsibility for Content

You are solely responsible for ensuring you have the right to process and extract frames from videos you use with Fliqer.

8. Photo Library Access

Fliqer requires access to your photo library to function. By granting access, you:

• Authorize the App to read videos from your library
• Authorize the App to save extracted frames to your library
• Acknowledge that all processing happens locally on your device
• Understand that we do not upload your videos to our servers

You can revoke this access at any time in iOS Settings, but this will prevent the App from functioning.

9. Intellectual Property

9.1 Our Rights

All rights, title, and interest in Fliqer, including but not limited to:

• Source code and software
• User interface and design
• Trademarks and branding
• Documentation and content

remain the exclusive property of Egor Sazanov.

9.2 Trademarks

"Fliqer" and the Fliqer logo are trademarks of Egor Sazanov. You may not use these marks without prior written permission.

10. Privacy and Data

Your use of Fliqer is also governed by our Privacy Policy. Please review it to understand our data practices.

Key Privacy Points:

• We process videos locally on your device
• We do not upload your videos or frames
• We collect minimal data for app functionality
• Your data is encrypted and secure

11. Disclaimer of Warranties

We disclaim all warranties, including but not limited to:

• Merchantability and fitness for a particular purpose
• Non-infringement of third-party rights
• Uninterrupted or error-free operation
• Accuracy or reliability of results
• Compatibility with all devices or iOS versions

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• We are not liable for any indirect, incidental, special, consequential, or punitive damages
• Our total liability shall not exceed the amount you paid for the App in the last 12 months
• We are not responsible for data loss, device damage, or other technical issues
• We are not liable for third-party actions or content

13. Indemnification

You agree to indemnify and hold harmless Egor Sazanov from any claims, damages, losses, or expenses arising from:

• Your use of Fliqer
• Your violation of these Terms
• Your content or extracted frames
• Your violation of any third-party rights

14. Termination

14.1 By You

You may stop using Fliqer at any time by:

• Deleting the App from your device
• Canceling your subscription in App Store settings
• Requesting account deletion (if applicable)

14.2 By Us

We may terminate or suspend your access if you:

• Violate these Terms
• Abuse the service or credits system
• Engage in fraudulent activity
• Harm other users or our reputation

14.3 Effect of Termination

Upon termination:

• Your license to use Fliqer immediately ends
• Unused credits are forfeited (no refunds)
• We may delete your account data per our retention policy
• Extracted frames remain on your device

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of changes through:

• In-app notification
• Email (if provided)
• Updated "Last Updated" date

Your continued use of Fliqer after changes constitutes acceptance of the new Terms.

16. Apple App Store Terms

Your use of Fliqer is also subject to Apple's App Store Terms of Service. In case of conflict, Apple's terms prevail regarding:

• App Store purchases and refunds
• Subscription management
• Device compatibility

Acknowledgment

You acknowledge that:

• These Terms are between you and Egor Sazanov, not Apple
• Apple has no obligation to provide support for Fliqer
• Apple is not responsible for product warranty claims
• Apple is a third-party beneficiary of these Terms

17. Dispute Resolution

17.1 Governing Law

These Terms are governed by and construed in accordance with the laws of the Russian Federation, without regard to its conflict of law provisions. For users outside the Russian Federation, local mandatory consumer protection laws shall also apply where applicable.

17.2 Jurisdiction

For users in the European Union, any disputes shall be subject to the jurisdiction of the courts of your country of residence. For users outside the EU, disputes shall be subject to the jurisdiction of the courts of the Russian Federation.

17.3 Informal Resolution

Before filing a claim, you agree to contact us at support@fliqer.app to resolve disputes informally. We commit to responding within 14 days and making good faith efforts to resolve the issue.

17.4 Alternative Dispute Resolution

If informal resolution fails, EU users may use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

17.5 Class Action Waiver

To the extent permitted by applicable law, you agree to resolve disputes individually and waive the right to participate in class actions.

• Contact customer support regarding any issues
• Use the EU Online Dispute Resolution platform
• File complaints with national authorities if needed

19. Miscellaneous

19.1 Entire Agreement

These Terms, along with our Privacy Policy, constitute the entire agreement between you and us regarding Fliqer.

19.2 Severability

If any provision is found unenforceable, the remaining provisions remain in full effect.

19.3 No Waiver

Our failure to enforce any right or provision does not constitute a waiver of that right.

19.4 Assignment

You may not assign these Terms. We may assign them without restriction.

19.5 Force Majeure

We are not liable for delays or failures due to circumstances beyond our reasonable control.
